These Terms of Service ("Terms") govern your access to and use of the services provided by RONX Technologies ("Company", "we", "us", or "our"), including our website at ronxtech.com, our software development and IT consulting services, and our WhatsApp Business messaging services. By accessing or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Acceptance of Terms
By accessing our website, engaging our services, or receiving messages from us through WhatsApp or any other communication channel, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. These Terms constitute a legally binding agreement between you and RONX Technologies.
If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Services
RONX Technologies provides the following services:
- Custom Software Development — Web applications, mobile apps, and enterprise software tailored to client requirements.
- IT Consulting — Strategic technology advisory, system integration, and technical architecture planning.
- Cloud Infrastructure — Cloud setup, migration, management, and ongoing technical support.
- Business Process Automation — Workflow automation, API integrations, bots, and custom automation tools.
- WhatsApp Business Messaging Services — Business communications delivered through the WhatsApp Business Platform (Meta Cloud API), including transactional notifications, customer support messaging, and template-based outreach.
Our WhatsApp messaging services are provided in compliance with the WhatsApp Business Terms of Service and the WhatsApp Business Policy.
3. WhatsApp Messaging Terms
When you interact with RONX Technologies through WhatsApp, the following terms apply in addition to the general terms outlined in this agreement.
3.1 Opt-In Requirement
We will only send WhatsApp messages to users who have provided explicit, informed consent (opt-in) to receive messages from us. We do not send unsolicited messages. Opt-in is collected through one or more of the following methods:
- Submitting a contact form or inquiry on our website with a clear checkbox or statement indicating consent to receive WhatsApp messages.
- Sending us a message on WhatsApp first, thereby initiating a conversation.
- Providing written or verbal consent during a business engagement or consultation.
- Opting in through a third-party service or form that clearly identifies RONX Technologies as the message sender.
In all cases, users are informed of the nature and frequency of messages they will receive before providing consent.
3.2 Types of Messages
We may send the following types of messages through WhatsApp:
- Template Messages — Pre-approved message templates used for business-initiated communications such as appointment reminders, order confirmations, shipping updates, and account notifications. These templates are reviewed and approved by Meta before use.
- Transactional Messages — Messages related to an ongoing transaction, service request, or business engagement, such as project updates, delivery confirmations, or payment receipts.
- Customer Support Messages — Responses to your inquiries, troubleshooting assistance, and follow-up communications related to support requests.
3.3 The 24-Hour Messaging Window
In accordance with WhatsApp Business Policy, when you send us a message on WhatsApp, a 24-hour customer service window opens. During this window, we may respond with freeform messages related to your inquiry. Once the 24-hour window has closed, we may only contact you using pre-approved message templates. We will not send promotional or marketing messages outside of an active conversation window unless you have explicitly opted in to receive them and the message uses an approved template.
3.4 Message Frequency
The frequency of messages you receive depends on the nature of your engagement with us. Transactional messages are sent as needed based on your service interactions. You will not receive excessive or irrelevant messages.
4. User Consent and Opt-In/Opt-Out Mechanisms
4.1 How to Opt In
You may opt in to receive WhatsApp messages from RONX Technologies by:
- Completing a contact or inquiry form on our website that includes a clear consent statement for WhatsApp communications.
- Initiating a WhatsApp conversation with us by sending us a message first.
- Providing explicit consent during a phone call, email exchange, or in-person meeting.
- Clicking an opt-in link or button provided in our communications.
4.2 How to Opt Out
You may withdraw your consent and opt out of receiving WhatsApp messages from us at any time using any of the following methods:
- Reply STOP — Send the word "STOP" as a reply to any WhatsApp message from us. We will acknowledge your request and cease sending messages.
- Contact Us Directly — Send an email to contact@ronxtech.com or call +91 701 001 3372 and request to be removed from our WhatsApp messaging list.
- Block Our Number — You may block our WhatsApp Business number at any time using WhatsApp's built-in blocking feature.
Upon receiving your opt-out request, we will process it promptly and stop sending WhatsApp messages within 48 hours. Opting out of WhatsApp messages does not affect other communications you may receive from us (e.g., email), unless you specifically request that as well.
4.3 Record Keeping
We maintain records of user consent (opt-in) and opt-out requests in compliance with WhatsApp Business Policy and applicable data protection laws.
5. Acceptable Use Policy
When using our services, you agree not to:
- Use our services for any unlawful, fraudulent, or malicious purpose.
- Send or request the sending of spam, unsolicited messages, or bulk messages that violate WhatsApp's policies.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorized access to our systems, accounts, or networks.
- Transmit any material that is defamatory, obscene, threatening, abusive, or otherwise objectionable.
- Interfere with or disrupt the integrity or performance of our services.
- Use our WhatsApp messaging services to send messages that violate the WhatsApp Business Policy or WhatsApp Business Terms of Service.
- Provide false, inaccurate, or misleading information in connection with your use of our services.
We reserve the right to suspend or terminate your access to our services if you violate this Acceptable Use Policy.
6. Data Protection and Privacy
We are committed to protecting your personal data. Our collection, use, storage, and sharing of personal information is governed by our Privacy Policy, which forms an integral part of these Terms.
In relation to our WhatsApp messaging services, we collect and process:
- Your phone number and WhatsApp profile name for the purpose of delivering messages.
- Message content and delivery status for service fulfillment and quality assurance.
- Opt-in and opt-out records for compliance purposes.
- Timestamps and interaction data for service improvement.
We do not sell, rent, or trade your personal data to third parties for marketing purposes. Data shared with Meta (WhatsApp) is governed by WhatsApp's Privacy Policy. We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction.
7. Intellectual Property
All content, materials, software, trademarks, logos, and intellectual property displayed on our website or provided as part of our services are the property of RONX Technologies or its licensors, unless otherwise stated. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent.
Intellectual property rights for custom software developed under a client engagement are governed by the specific terms of the applicable service agreement or contract between RONX Technologies and the client.
8. Limitation of Liability
To the maximum extent permitted by applicable law, RONX Technologies and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of our services.
Our total aggregate liability for any claims arising from or related to these Terms or our services shall not exceed the amount you have paid to RONX Technologies for the specific service giving rise to the claim during the twelve (12) months preceding the claim.
We do not guarantee uninterrupted or error-free delivery of WhatsApp messages. Message delivery is subject to WhatsApp platform availability, Meta's policies, network conditions, and recipient device status. We shall not be held liable for any delays or failures in message delivery caused by factors beyond our reasonable control.
9. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. Either party may initiate this process by sending a written notice describing the dispute to the other party.
If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through arbitration or the courts, as described in the Governing Law section below.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India. This applies regardless of your location or the location from which you access our services.
11. Changes to Terms
We reserve the right to modify or update these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. We may also notify you of significant changes through our website or via WhatsApp, where applicable.
Your continued use of our services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically to stay informed of any updates.
